Do I Need Planning Permission?
Putting up decking, or other raised platforms, in your garden is permitted development, not needing an application for planning permission, providing:
• The decking is no more than 30cm above the ground
• Together with other extensions, outbuildings etc, the decking or platforms cover no more than 50 per cent of the garden area.
Conservatory in a Conservation Area: If your property is in a Conservation Area or in a World Heritage Site, planning consent may be required. Please check with your local authority prior to starting any works. It is absolutely necessary to obtain the required conservation area consent prior to beginning any works. Going ahead without this may result in a fine or imprisonment, or both.
Conservatory in Flats or Maisonettes: Permitted development rights may not be applicable to you if you live in a flat or a maisonette and wish to install decking. Please check with your local authority prior to starting any works
Note - If you are a leaseholder you may need to get permission from your landlord, freeholder or management company, if you wish to install decking.
